The Hire Agreement.
These terms apply from the moment you make a booking with us. If anything here is unclear, ring us before you book rather than after.

The agreement
Terms of Hire
These are the terms you accept when you book. They are the same terms our drivers work to, so nothing here should be a surprise on the day.
Booking and payment
By making a booking you enter into a contract with Party Hire Brisbane and accept these terms from the date of that booking. The company or person who makes the booking is liable for all payment.
Payment can be made before the event by EFT. Cash is the only method accepted on the day, and the person hiring must be present at delivery with the correct change, or must have left the money with someone who will be present. If nobody is there to pay on delivery, we reserve the right not to deliver.
We reserve the right to change prices and specials on this site at any time without notice.
Cancellations
Bookings cancelled more than 48 hours before the event date incur a non-refundable charge of 50%. Bookings cancelled within 48 hours of the event date incur a 100% cancellation fee.
The same applies to items removed from an order or quantities reduced: 50% outside 48 hours, 100% inside 48 hours.
Where management grants a credit on a booking, that credit must be used within six months of the original booking date.
Weather and rescheduling
Party Hire Brisbane reserves the right to reschedule a booking where delivery or setup would be a safety risk — torrential rain, hail, flooding, extreme storms, earthquake, or an area being closed off.
If we cannot deliver later the same day we will deliver on the next available day. If your event cannot be rescheduled at all, a credit can be applied to a future booking.
The hire period
The hire is for the booked period unless both parties agree otherwise in writing. Failure to return equipment, or our drivers being unable to access it for collection, incurs a daily charge for every day beyond the agreed period. This may be taken from the bond, and any further charges invoiced.
If the hirer fails to return equipment, the hirer gives us permission to enter the premises where it is held to collect it, without us being responsible for any damage caused in doing so.
Responsibility for the equipment
The hirer accepts full responsibility for the equipment from the time it is delivered until the time it is collected. If the driver is held up and misses the scheduled collection time, the hirer remains liable until the driver arrives.
The hirer is liable for the replacement cost of any equipment that is stolen, goes missing, is vandalised or broken, and for any damage caused to it.
The hirer must inspect all equipment and tell us at the time of delivery if anything is missing, damaged or unfit for use. Failure to do so leaves the hirer responsible for it at collection.
The equipment remains the property of Party Hire Brisbane at all times. This contract may not be transferred to another party without our written consent.
Delivery and access
The hirer is responsible for having someone available to take delivery at the nominated date and time. If nobody is there, an additional delivery fee is charged to redeliver.
Delivery and collection is between 10am and 2pm, seven days a week, excluding public holidays. Deliveries outside those hours may incur an additional fee. Same day collections may incur a fee to cover a separate driver.
Delivery is to ground level only. Extra charges apply where the equipment must be carried more than 10 metres from where our vehicle can park, and for stairs, steep descents and upper levels. The hirer must tell us by email if any of these apply. Failure to do so results in extra charges, and in extreme cases refusal to deliver.
Safety and liability
The hirer assumes proper knowledge of the operation and handling of the equipment, follows workplace health and safety practice, and does not hold Party Hire Brisbane responsible for any injury caused to themselves or others while moving or setting up equipment.
No warranty is provided as to the equipment’s fitness for any particular use. We may substitute a similar item where the original is unavailable due to unforeseen circumstances.
The hirer agrees to defend, indemnify and hold Party Hire Brisbane harmless from any claims, demands, damages, losses, suits, proceedings, penalties or expenses arising out of the use of the equipment.
General
Customers who provide an email address when booking agree to receive occasional email specials. Tell us when booking if you would rather not.
The laws of Queensland govern this agreement, and any legal proceedings connected with it will be brought in Queensland.
These terms can only be amended by Party Hire Brisbane. Any change to this contract must be in writing and signed by both hirer and supplier. Oral agreements are not binding, and the latest contract supersedes all previous ones.
If a court determines any provision of this agreement to be invalid or unenforceable, that affects only that provision. A waiver of any term applies only to the specific instance it was given for.
